Elon Musk's pro-Trump super PAC, America PAC, awarded its final $1 million prize on Tuesday to a registered voter in Michigan, closing out a high-stakes sweepstakes that has drawn considerable legal scrutiny. The daily giveaway program, which operated in various battleground states, aimed to incentivize voter participation through substantial cash prizes.
The final winner was announced just one day after a Pennsylvania judge denied a request from the Philadelphia district attorney to halt the program. The district attorney had filed a civil lawsuit, alleging that the sweepstakes violated Pennsylvania’s gaming laws. The legal action was based on concerns that the sweepstakes encouraged voting through financial incentives, which could be interpreted as a form of vote-buying.
In a statement posted on X, America PAC thanked participants who supported what it described as “the Rights to Free Speech and Bear Arms,” referring to the petition that registered voters could sign to enter the sweepstakes. This messaging aimed to rally support among voters with shared values, using the sweepstakes to engage politically active participants in crucial states.
The program awarded a total of $18 million in $1 million increments to 18 registered voters across battleground states. Despite the Philadelphia lawsuit and a separate caution from the Justice Department about potential violations of federal vote-buying laws, America PAC continued its operations. The Justice Department had previously issued a warning that the sweepstakes might conflict with regulations against using monetary incentives to influence voter behavior.
The $1 million giveaway has sparked discussions about the legal and ethical boundaries of incentivizing voter turnout, particularly in contentious battleground areas. With the sweepstakes now concluded, it remains to be seen if further legal action will arise. However, Musk’s America PAC stands firm on its stance, positioning the initiative as an effort to uphold freedom of speech and other constitutional rights, while navigating the complex intersection of politics and incentives.
